iHTTP Hosting Terms of Service

By ordering any service you agree to the following terms of service.

1. Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. You must provide IHTTP with a valid email address so we can contact you with further details on your order. IHTTP will make every effort to setup all accounts within 24 hours of ordering however when this is not possible you agree to hold harmless IHTTP from any claims to do with the time setting up accounts. In the event our fraud partners suspect fraudulent activity, we may require you to send photographic proof of ID and a recent utility bill. These will be destroyed from our systems when verified. You agree to hold iHTTP harmless for any claims resulting in any delay of order processing due to our third party providers suspecting fraud.

2. Content
All services provided by IHTTP may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene. The customer agrees to indemnify and hold harmless IHTTP from any claims resulting from the use of our services.

Examples of unacceptable material:

* IRC Bots
* Proxy Scripts / Anonymizers (Unless Authorised)
* Warez Sites
* Pirated Software
* Hate sites
* Hack programs and archives
* Adult Sites

Please note IHTTP has a ZERO tolerance of Adult Sites, IHTTP reserves the right to terminate any accounts of this nature without warning and will not give a refund. All rights reserved.

IHTTP will take no responsibility for any illegal music which is broadcast via its servers, the user of the account is responsible for all content that is used via there account and web space. IHTTP reserves the right to cancel any service with good reason.

3. Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists” and “double optin” will be treated as spam. Any user who sends out spam will have their account terminated without notice.

IHTTP reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. IHTTP also reserves the right to make any such modifications in an emergency at our sole discretion.

IHTTP reserves the right to charge a fee for any damages caused by Spamming. This fee will be at the discretion of IHTTP. All Rights Reserved.

4. Payment Information
You agree to supply appropriate payment for the services received from IHTTP, in advance of the time period during which such services are provided. You agree that until and unless you notify IHTTP of your desire to cancel any or all services received, those services will be billed on a recurring basis.

IHTTP reserves the right to change the prices of accounts at any time without notification should this be necessary.

IHTTP reserves the right to suspend any account whose services have not been paid after 24 hours from payment due date

5. Backups and Data Loss
Your use of the service is at your sole risk. IHTTP is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers. If for any reason you need to restore from a backup a £10 charge can be paid and restored to weekly host backup. Support must be contacted for this. We do process daily backups of all websites on specific days of the week, these can be used but we would always recommend enuring you have your own backup. IHTTP reserve the right to change this at any time.

6. Cancellation and Refunds
Account cancellation must be requested at least 5 business days prior to account renewal. All invoices and bills must be paid prior to account cancellation. Account cancellation will take place on the date of renewal, and as such will not be liable for any refund or credit, backups will not be provided.

All cancellation requests must be made via a support ticket in the client area, or “View Product” area where you can click the “Cancel Service” option.

IHTTP reserve the right to cancel any account, without warning and refund. Refunds will be given in extreme circumstances, and your request for a refund may be assessed by our Risk Mitigation Team.

7. Resource Usage
Users may not initiate the following:

a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.

8. Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should you go over your limit you must contact support and arrange for this to be increased. This is Subject to additional charge which will be at the sole discretion of IHTTP.

9. Domain Registration
All Domain names registered via iHTTP Webservices are registered via our 3rd party, you can read their full terms of registration here. By registering a domain name through iHTTP Webservices you agree fully to both our terms and the terms of our 3rd party.

a) Domain registration will not be completed until paid for.
b) If you decide to move to another hosting provider, you can change your name servers within our billing system, if this option is unavailable you must submit a support ticket and we will change these for you at no cost.
c) If you wish to move your domain name to another provider we will apply a £12.00 charge for administrative costs associated to moving the domain name, this will ensure a smooth transaction and we will provide you with EEP code’s to ensure no possible registration from another person/company.
d) We will notify you in advance of any domain renewal, if however you have not paid this before the renewal date we provide no guarantee that your domain name can be saved, we accept no liability if this is the case.

e) If your account is in arrears, you must clear any outstanding balance before a domain transfer is initiated.

10. Price Change
The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on IHTTP, and the right to increase the amount of resources given to plans at any time.

11. Special Offers
IHTTP reserves the right to add or remove any special offer without warning at any time. All rights reserved.

12. Support Policy
The Company will provide priority technical support services to the Customer for provided Services, subject to the terms of the Agreement. Technical support services are available during the vast majority of the day with a ticket resolved response time of 12 hours and a max resolve time of 24 hours attempted under most circumstances. There will be time when this is not possible and IHTTP do not take responsibility for this. All technical support issues are handled solely via our online ticketing system. Technical support is NOT available via telephone, instant messenger, or any other method those mentioned above. We limit our technical support services to our area of expertise. We provide support solely for issues directly related to the physical functioning of your account. In all cases, assistance with coding, programming, or third-party programs is not covered by our technical support.

13. Disclaimer
IHTTP will not be responsible for any damages of any kind that you or your business may suffer as a result as a result of using its services. This includes but it is not limited to loss of data and any service interruptions as caused by our host provider. IHTTP will do every effort to keep any of these to a minimum as is with its control. You agree not to hold IHTTP harmless for any such claims.

14. Cease of Service
IHTTP reserve the right to cancel any account at any time for good reason.

15. Changes to the TOS
IHTTP reserves the right to revise its policies at any time without notice.
